Although McAfee admitted in a tweet on February 18, 2018, that he received payments for promoting ICOs, the full legal implications are still unclear. Legal Issues and Current Status While these activities may not have appeared overtly illegal, they carry significant legal risks if the allegations prove true. On July 25, 2017, the Securities and Exchange Commission (SEC) issued “The ICO Report,” which suggested that ICOs could be classified as securities under federal law. Subsequently, on November 1, 2017, the SEC warned against ‘touting’ ICOs without proper disclosure.
